Terms of Service

Please read these terms and conditions carefully before using our service. By accessing or using the Service, you agree to be bound by these Terms.

1. Services Overview

Protoforma and its division Protoforma Nex3D provide manufacturing, rapid prototyping, and engineering services based on digital files and specifications submitted by the client. Quotes are valid for 14 days from the date of issue unless otherwise stated.

2. Intellectual Property & File Ownership

The client retains all intellectual property rights to the CAD models, drawings, and specifications submitted to Protoforma. By submitting a file, the client grants Protoforma a limited, non-exclusive license to use the file solely for the purpose of manufacturing the requested parts and providing the associated services.

The client warrants that they have the right to manufacture the submitted designs and that such manufacturing does not infringe upon the intellectual property rights of any third party.

3. Quality & Tolerances

We manufacture parts according to standard tolerances for the chosen technology and material, as outlined in our specifications or in your accepted quote. If specific tighter tolerances are required, they must be explicitly agreed upon in writing prior to order confirmation.

4. Returns & Rework

Due to the custom nature of our manufacturing services, all sales are final. If a part does not conform to the agreed-upon specifications or tolerances due to a manufacturing defect on our part, we will, at our discretion, rework or reprint the part at no additional cost. Claims for defects must be made within 7 days of delivery.

5. Limitation of Liability

Protoforma's liability for any defective product shall be limited to the replacement or repair of the defective part. In no event shall Protoforma be liable for any indirect, incidental, or consequential damages, including loss of profits, arising out of the use or inability to use our manufactured parts.
