1. Overview & Definitions

1.1 Agreement to Terms

Precision Forge 3D Prototyping ("Precision Forge," "we," "us," or "our") provides design, modelling, consulting, 3D printing services, and sells prebuilt 3D models.

By placing an order, submitting design files, making payment, or using any services, you ("client," "you," or "your") explicitly agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.

1.2 Key Definitions

• "Printing Started": Printer has begun material deposition
• "Modelling Started": Design/modelling work has commenced (tracked via project management system)
• "Quote Acceptance": Payment of advance OR written confirmation via email/WhatsApp
• "Minor Deviation": Variation within ±5% of specified dimensions due to prototyping nature
• "Business Day": Monday-Friday, excluding public holidays in Maharashtra
• "Minor Edit": Small adjustments in dimensions, colors, or surface details that do not alter the core design

2. Service Scope & Product Sales

2.1 Services Provided

• 3D Design & Modeling
• AutoCAD Drafting
• 3D Printing Services
• Design Consulting
• Prototype Development

2.2 Products Sold

• Prebuilt 3D Models (physical products)
• Design Files (digital products)

2.3 Shipping Options

Clients have two shipping options:

• Client-Arranged Shipping: Client manages pickup and shipping
• Our Shipping Service: We arrange shipping at additional cost

Geographic Restriction: We currently serve Mumbai metropolitan area only.

Exception: Orders valued at ₹20,000 or above may be shipped outside Mumbai at our discretion.

2.4 Design Modification Policy

• Minor Edits: Included in original quote (dimensions, colors, surface details)
• Major Changes: Treated as new design requests with additional charges

Decision on edit classification at our sole discretion.

3. Eligibility & Compliance

• Services available to individuals aged 18+ or entities with legal capacity
• Clients must ensure all designs comply with applicable laws
• Business clients should note that we are currently not GST registered

4. Quotes, Payments & Cancellations

4.1 Quotes & Validity

• Quote Validity: 7 calendar days from issuance
• Acceptance Deadline: Quote must be accepted within validity period
• Acceptance Defined: Payment of advance OR written confirmation via email/WhatsApp

4.2 Payment Structure

4.3 Cancellation Policy

Important: Design/development charges are non-refundable once modelling has started.

4.4 Credit Notes

• Issuance: When order switched to different order OR cancellation after 1 hour
• Validity: 6 months from issuance date
• Transferability: Not transferable to other clients
• Usage: Can be used for full-price orders only (not combinable with discounts)
• Expiry: Unused value forfeited after 6 months

4.5 Deletion Requests

Due to operational, legal, and safety requirements, deletion requests for project data cannot be honored once services have commenced. See Privacy Policy Section 6 for details.

5. Client Responsibilities

• Provide virus-free, legally compliant design files suitable for 3D printing
• Ensure files do not infringe third-party intellectual property
• Choose shipping option (client-arranged or our service)
• Provide accurate contact and delivery information
• Review and approve designs before printing begins
• Note that we are not currently GST registered and cannot provide GST invoices

6. Quality, Warranty & Replacements

6.1 Quality Assurance

• All prints undergo mandatory quality control before shipment
• Minor deviations (±5%) are inherent to prototyping and not considered defects

6.2 Reprint Guarantee

We guarantee reprints in case of:

• Print failures due to equipment malfunction
• Print failures due to material defects
• Print failures due to operator error

Exclusion: Reprint guarantee does NOT apply to "Prototype Tier" orders where risks are priced accordingly.

6.3 Replacement Process

1. Client must notify us within 7 days of delivery
2. Provide clear photos/video showing the defect
3. Return defective print (client pays return shipping)
4. We inspect and confirm manufacturing defect
5. Replacement shipped at our expense (Mumbai) or client's expense (outside)

7. Intellectual Property Rights

7.1 Client-Owned Designs

• Clients retain full ownership of original designs they provide
• We acquire no rights to client IP except as specified below
• Clients warrant they have rights to all submitted designs

7.2 Our Usage Rights for Marketing

We reserve the right to:

• Showcase completed projects in our portfolio
• Use project images for marketing and promotional purposes
• Reference project types and industries served

Important Conditions:

• We will remove/hide proprietary features before showcasing
• We will not disclose critical dimensions or technical specifications
• We will edit designs as needed for marketing purposes

Clients may opt-out of design reuse by written request. Opt-out requests must be made before project completion.

8. Limitations of Liability

8.1 Our Liability

We are liable only for:

• Direct damages during our managed delivery within Mumbai
• Reprints for print failures as per Section 6
• Errors directly resulting from services we control

8.2 Exclusions from Liability

We are NOT liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Client-handled shipping damages
• Misuse or modification of prints
• Third-party actions or errors

9. Turnaround Time & Delivery

9.1 Standard Turnaround Times

Delivery times vary based on order complexity and size:

• Small/Single Items: 2 hours to 1 business day
• Medium Projects: 1-3 business days
• Large/Complex Projects: 3+ business days (quoted individually)
• Design/Modelling: 1-10 business days based on complexity

Note: Times are estimates and may vary due to workload, material availability, or technical issues.

9.2 Expedited Service

• Expedited service available at 50% premium
• Must be requested and confirmed before order placement
• Not available for all project types

10. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including:

• Natural disasters
• Power failures or utility disruptions
• Equipment/machine malfunctions
• Material supply chain issues
• Government actions or restrictions

11. Data Protection & Privacy

11.1 Data Collection & Storage

We collect and store client data including:

• Contact information
• Design files and project specifications
• Communication records
• Payment information (processed securely)

11.2 Data Retention

• Client files archived securely for operational, legal, and safety purposes
• Retention period: Minimum 2 years as per legal requirements
• Secure storage with access controls

11.3 Privacy Policy

11.4 Data compromise

While we will be trying our best to protect client data, we cannot guarantee absolute security. In the unlikely event of a data breach, we will notify affected clients promptly and take all necessary steps to mitigate the impact.

Our liability for any data compromise is limited to the total fees paid to us in the thirty days prior to the incident. A data compromise refers to any unauthorized access, disclosure, alteration, or loss of data.

12. Dispute Resolution

12.1 Dispute Notification

• Disputes must be raised in writing within 15 days of the event
• Must include order number and supporting evidence
• Photos/video required for quality disputes

12.2 Resolution Process

1. Written notification of dispute
2. We acknowledge within 2 business days
3. Investigation period: 15 business days
4. Proposed resolution within 30 days total

13. Marketing & Communications

• We may send service-related communications (order updates, etc.)
• Marketing emails can be opted out anytime by contacting us directly via the given contact details which can be found on the footer or the header of our website.
• Promotional offers subject to separate terms

14. Safety & Use Disclaimers

14.1 Prototype Nature

CRITICAL DISCLAIMER: All prints are PROTOTYPES unless explicitly stated otherwise.

• Not for commercial production without testing
• Not for load-bearing or structural applications
• Not for life-critical or medical uses
• Materials may have limitations

14.2 Client Responsibility for Use

Clients are solely responsible for:

• Testing prototypes for intended use
• Ensuring safety in final applications
• Complying with product safety regulations

15. Applicable Laws & Jurisdiction

15.1 Governing Laws

Our operations comply with Indian laws including:

• Indian Contract Act, 1872
• Information Technology Act, 2000
• Indian Penal Code
• Copyright Act, 1957
• Consumer Protection Act, 2019

15.2 Jurisdiction

• Governing law: Laws of India
• Exclusive jurisdiction: Courts in Mumbai, Maharashtra
